01 Agreement to these terms

These Terms of Service ("Terms") govern your use of emlawn.com and any purchase you make from emlawn ("emlawn", "we", "us" or "our"). By using our website or placing an order, you agree to these Terms. If you don't agree, please don't use the site.

These Terms work together with our Privacy Policy, Shipping & Delivery Policy, Refund & Return Policy and Cookie Policy.

02 Who can use our store

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you confirm that the information you give us is accurate and that you're authorised to use the payment method you provide.

We currently sell and ship to addresses in the United States only.

03 Your account

You can check out as a guest or create an account. If you create one, you're responsible for keeping your password secure and for activity under your account. Tell us right away if you think someone else has accessed it.

We may suspend or close accounts that break these Terms or are used for fraud.

04 Products and descriptions

We sell new generators, power stations, pressure washers and related equipment from third-party manufacturers. We work to describe products and specifications accurately, but details such as wattage, PSI, dimensions, weight and included accessories come from manufacturers and can change without notice.

• Product images are for illustration and may differ slightly from the item you receive
• Colours can look different depending on your screen
• If a product isn't as described, your remedy is to return it under our Refund & Return Policy

Check that a product suits your needs, such as power requirements, fuel type, local emissions rules and installation requirements, before ordering. If you're unsure, ask us.

05 Pricing and payment

All prices are in US dollars. Standard shipping within the United States is free. Applicable sales tax is calculated and shown at checkout.

We may change prices at any time, but changes won't affect orders we've already accepted. If a product is listed at an obviously wrong price because of a typing or system error, we may cancel the order and refund you in full, even after you've received an order confirmation.

We accept the payment methods shown at checkout. Payments are processed securely by our payment providers; we don't store your full card details.

06 Orders, acceptance and cancellation

Your order is an offer to buy. The order confirmation email confirms we've received it; the contract is formed when we ship your order. We may refuse or cancel an order, for example if:

• The product is out of stock or discontinued
• There's a pricing or description error
• Payment can't be verified, or the order appears fraudulent
• We can't ship to the address provided

If we cancel an order after you've paid, we'll refund you in full.

Cancelling your order

You can cancel free of charge any time before your order ships by contacting us as soon as possible. Once it has shipped, our Refund & Return Policy applies instead.

07 Shipping and delivery

Orders are processed within 0–1 business days and delivered within 1–3 business days after shipping. Delivery dates are estimates, not guarantees. Full details, including freight delivery for large items and what to do if an order arrives damaged, are in our Shipping & Delivery Policy.

Ownership and risk of loss pass to you when the order is delivered to your shipping address.

08 Returns and refunds

You can return eligible items within 30 days of delivery if they're unused and in their original packaging. Products that have been fuelled, run or installed can't be returned as new. See our Refund & Return Policy for full details.

09 Warranties

Products we sell are covered by the manufacturer's warranty, where one is offered. Warranty terms vary by brand and model and are set out in the documentation that comes with the product. Warranty claims are handled under the manufacturer's terms, and we're happy to help you start one.

Except for the manufacturer's warranty and any rights you have under law that can't be excluded, products are sold "as is" and emlawn makes no additional warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose.

Some states don't allow certain warranty exclusions, so some of the above may not apply to you.

10 Safe use of products

You're responsible for using, installing and maintaining products safely and in line with the manufacturer's instructions and local laws. In particular:

• Read the operator's manual before first use
• Never connect a generator to a home's wiring without a properly installed transfer switch or interlock
• Standby generators must be installed by licensed professionals, with any required permits
• Pressure washers can cause serious injury; never point the spray at people or animals
• Check your local emissions and noise rules (for example, CARB requirements in California)

emlawn is not responsible for damage or injury caused by misuse, improper installation or failure to follow the manufacturer's instructions.

11 Limitation of liability

To the fullest extent permitted by law, emlawn and its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, lost data, or losses caused by a power outage or product failure, arising from your use of our website or products.

Our total liability for any claim relating to an order will not exceed the amount you paid for the product involved.

Nothing in these Terms limits liability that can't be limited by law, such as liability for death or personal injury caused by negligence. Some states don't allow these limitations, so they may not apply to you.

12 Indemnification

You agree to indemnify and hold emlawn harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of a product, or your violation of any law or third-party rights.

13 Intellectual property

The emlawn name, logo, website design, text and original content belong to emlawn and are protected by law. You may not copy, reproduce or use them for commercial purposes without our written permission.

Product names, brand names and logos belong to their respective manufacturers and are used only to identify their products. Their use doesn't imply endorsement of emlawn by those manufacturers.

14 Reviews and content you submit

If you submit a review, photo, question or other content, you confirm it's your own, it's honest, and it doesn't break any law or anyone's rights. You give us a non-exclusive, royalty-free licence to display and use that content on our website and marketing.

We may remove content that is false, offensive, off-topic or unlawful.

15 Acceptable use

When using our website, you agree not to:

• Use the site for fraud or any unlawful purpose
• Place orders using someone else's payment details without permission
• Attempt to hack, overload or disrupt the site, or bypass its security
• Scrape or copy site content or prices by automated means
• Buy products for resale without our written agreement

16 Third-party links

Our site may link to third-party websites, such as manufacturers or carrier tracking pages. We don't control those sites and aren't responsible for their content or practices.

17 Governing law and disputes

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law rules. Any dispute that can't be resolved informally will be handled by the state or federal courts located in Cook County, Illinois, unless the law where you live gives you the right to bring a claim locally.

Before starting any formal claim, please contact us first. Most problems can be sorted out quickly by email.

18 Changes to these terms

We may update these Terms from time to time. Changes take effect when posted on this page, and the "Last updated" date will change. The Terms in force when you place an order apply to that order.

19 General

• Severability: if any part of these Terms is found unenforceable, the rest stays in effect
• No waiver: if we don't enforce a term right away, we can still enforce it later
• Entire agreement: these Terms and the policies linked above are the full agreement between you and emlawn about using our site
• Events outside our control: we're not liable for delays caused by events beyond our reasonable control, such as severe weather, natural disasters or carrier disruptions
